The Terms of Use outline the rules and guidelines for using a website that sells ready-made and custom-made furniture, including the collection and use of personal information, disclaimers, and limitations of liability.

Introduction

These General Terms and Conditions ("Terms") govern your access to and use of the website www.andwoodworks.com and www.andww.com ("Website"), operated by &WoodWorks Limited ("we", "us", "our"), and the products and services provided through the Website, including the purchase of ready-made furniture and custom-made ("Products"). By accessing and using the Website, registering an account, or making a purchase, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the Website.

User Accounts

(a) To access certain features of the Website, you may be required to register a user account. When registering an account, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account and password, and you agree to accept responsibility for all activities that occur under your account or password.

(b) Alternatively, you may choose to check out as a guest, in which case you will be required to provide your personal information and shipping address to complete your purchase.

(c) We reserve the right to suspend or terminate your account and refuse any current or future use of the Website if we believe you have provided false, inaccurate, or incomplete information, or if we believe you have violated these Terms.

Product Information

(a) Kindly note that there may be a size tolerance of +/- 4cm for sofas, other upholstery products, and custom-made items. Measurements should be taken at the widest point.

(b) Be advised that color deviations may occur in product images due to screen displays, wood characteristics, or paint. We encourage customers to consider these factors when making a purchase.

(c) Our wooden furniture is meticulously crafted from solid wood or a blend of solid wood and plywood with a natural veneer. As each wood piece possesses distinct grain patterns, the appearance of the final product may vary from our samples or photos. The uniqueness of wood grain contributes to the charm and individuality of each furniture piece.

Orders and Payments

(a) By placing an order on the Website, you agree to pay the indicated price for the selected Product(s), as well as any applicable taxes and shipping fees.

(b) You may cancel or change your order for any reason within 24 hours after receiving the order confirmation email. After that time, we cannot guarantee that orders can be canceled. Custom-made orders cannot be canceled once the manufacturing process has started.

(c) We reserve the right to refuse or cancel any order for any reason, including, but not limited to, product unavailability, errors in product descriptions or prices, or concerns about the user's payment method. In the event that we cancel your order, we will notify you and issue a refund for any payments made.

Shipping and Delivery

(a) The standard lead time for both ready-made orders and custom-made orders is approximately 4-12 weeks and 8-12 weeks, respectively. This is subject to the availability of the furniture manufacturer and overseas shipping time.

(b) You must ensure that furniture packaging can fit through all access points at the delivery address. If delivery fails due to this, the customer will be charged the day's transportation fee and additional shipping costs. No refunds or returns will be provided. Contact us for dimensions before scheduling a delivery.

(c) If furniture needs unpacking to fit through access points, the store will seek customer consent. Damage caused during unpacked transportation will be the customer's responsibility. Unnoticed unpacking requests may lead to additional shipping charges.

(d) Delivery and installation services exclude stair movement, pushing beyond 50 meters, wall mounting, or furniture disposal. Notify us in advance of these services and expect additional fees. Products with included installation services will incur extra fees if installation is scheduled separately from delivery. Refer to the "Surcharge" section below.

(e) You are liable for damages for any loss or damage(s) to the customer’s home caused by furniture delivery during and/or additional service provisions (e.g., drilling, plumbing). The store is not responsible for any issues arising from customers choosing not to wall-mount products, as recommended.

(f) Customers must notify the store a day before the delivery day for any changes. Failure to provide timely notice may result in non-refundable delivery fees and extra charges for rescheduling.

(g) The specific delivery days can't be immediately confirmed, we will inquire about the earliest possible date. The final delivery date will be confirmed via WhatsApp and phone when the product is ready.

(h) The store holds the right to make final decisions on any fees.

Returns and Refunds

(a) If you are unsatisfied with your purchase, you may return the Product(s) within 3 days of delivery. To qualify for a return, the Product(s) must be unused, in the same condition you received them, and in the original packaging. Please contact us with a detailed explanation and accompanying photos as evidence of the return request. A restocking fee of 30% will be charged for all accepted returns.

(b) Products are non-refundable for the following reason:
- Color discrepancies between screen displays or samples and the actual product(s).
- Dissatisfaction with natural wood grain or patterns.
- Item(s) that do not fit within the interior furniture layout.
- All custom-made item(s) (including color and size), as they are specifically manufactured and ineligible for cancellation, return, or refund.

(c) Refunds will be processed within 14 business days after we receive and inspect the returned Product(s). The refund will be issued using the same payment method used for the original purchase, minus the 30% restocking fee for accepted returns.

Surcharge

(a) Additional Delivery Fees

For certain areas in Hong Kong, extra delivery fees apply:

Tung Chung - $120
Ma Wan - $200
Discovery Bay - $300
Outlying Islands - $500

(b) Staircase and Distance Fees

If the delivery destination requires pushing the cart over 50 meters or lacks an elevator:

$100 per item 
$150 per item per floor 

(c) Delivery and Installation Rescheduling Fee

If no one is available to receive the delivery on the scheduled date or if the installation cannot be completed on the scheduled delivery date, additional fees will be charged for rescheduling:

$500 per item
$500 per session

(d) Return/Exchange Service Fee

$500 per trip

(e) Recycling or Disposal Fee

$500 per item

Intellectual Property

All content on the Website, including text, images, graphics, logos, and designs, is the property of [Company Name] or its content suppliers and protected by international copyright laws. You may not use, reproduce, or distribute any content from the Website without our express written consent.

(a) These Terms and any disputes arising out of or in connection with these Terms or your use of the Website shall be governed by and construed in accordance with the laws of Hong Kong SAR.

(b) You agree to submit to the exclusive jurisdiction of the courts of Hong Kong SAR to resolve any disputes arising out of or in connection with these Terms or your use of the Website.
